How To Determine if Someone Is Married or Divorced in Alameda County
If you want to access Alameda County marriage records or look up divorce details on anyone in the county, the primary record custodian is the County Clerk-Recorder’s Vital Records Department.2
These records can be viewed to check if someone is married and whether or not they were ever divorced.
To make a request for Alameda County marriage records, you can do so online, by mail or in person.3 Because of California law, your ability to access marital records depends on whether or not the parties you are searching for received a public or confidential marriage license. If it was a confidential marriage, then only the parties to the marriage can request a copy of the certificate.
If it was a public marriage, anyone can request an informational copy. Informational copies are helpful if you just want to find out if someone is married, but they cannot be used to establish someone’s identity. If you want an official record to establish identity, you will need an unrestricted marriage certificate.
However, if you want to request an unrestricted copy, then you must be one of the following people:
- Party to the Marriage
- Parent
- Legal Guardian
- Child
- Grandparent
- Sibling
- Spouse
- Grandchild
- Domestic Partner
- Executor
- Law Enforcement or Government Agency (for official business)
The guidance below explains how you can request an unrestricted and informational marriage record with the Vital Records Department of the Clerk Recorder’s Office.
Online: The Clerk-Recorder’s Office provides an online option to request either an unrestricted marriage certificate or an informational copy.4, 5 To make an online request, you will need to provide the following information:
- Full Name of Both Parties
- Date of Marriage
- City (where the license was issued)
If you’re requesting an unrestricted copy, some additional requirements apply; you will need to provide a statement that you are one of the above-listed individuals and that you are authorized to request a marriage certificate. After completing your online request, you’ll receive a pre-filled authorization statement to complete and sign.
- Picking up the marriage record in person: You must provide official government identification and sign the authorization statement at the Clerk-Recorder’s Office.
- Having the marriage record delivered: You must submit the signed and notarized statement before your request will be processed.
Mail: To request a marriage record by mail, you’ll need to complete an Application for Informational Certified Copy of Marriage Certificate or an Application for an Unrestricted Copy of Marriage Certificate Form.6, 7 For unrestricted copies, the written application will have to be notarized. For both requests, you will then mail your completed application to the below address:
Alameda County Clerk Recorder’s Office
1106 Madison St.
Oakland, California 94607
In Person: If you would like to make a request in person, you can complete the Application for informational copy or Application for an unrestricted copy at the Clerk-Recorder’s Office. To request an unrestricted copy, you will be required to provide government-issued identification.
The Alameda Clerk Recorder’s Office hours are Monday through Friday from 8:30 AM – 5:00 PM. Marriage records from 1971 to the present are typically completed on the same day. However, marriage records from 1854 to 1970 can take up to three business days to complete.
If you have additional questions about the process of searching and requesting a marriage record, you can call them at 888-280-7708.
Note: Regardless of what type of marriage record you request, the fee is $19.00 per copy. You can pay by check, money order or traveler’s checks. This fee is required regardless of whether a marriage record is found.
If you need to expand your search, you can also search and obtain married records through the California Department of Public Health.
